If you are facing employment complaints, litigation potential, or brewing conflicts that are undermining morale and productivity, try mediation first. Mediation improves and even transforms relationships. When you choose mediation, instead of somebody winning more or less and somebody losing more or less, participants collaborate on problem solving and voluntarily arrive at a joint agreement. Mediation resolves problems, expedites solutions, avoids risk, and preserves relationships. Think your disputants are too hot-headed to even consider it? Maybe not! Trained mediators have the skill to de-escalate anger and turn it into positive energy. Participants know that there is a cost to their conflict in stress, emotion, and potential financial loss. Mediation is far less expensive and more productive than the alternatives, motivating "conflictees" to try other means. Anne Milkovich is a trained mediator who volunteers regularly for Project Settle, the district court mediation program for Gallatin County. Anne serves attorneys and private parties in all civil matters, with a special focus on workplace conflicts and employment disputes.
